Terms of Service
The terms that govern your use of the PolicyOptic platform.
What PolicyOptic Is
PolicyOptic operates a software platform that helps boat owners organize marine insurance documents and request marine insurance quotes, and helps insurance professionals review qualified opportunities and client documents. PolicyOptic is a technology and communications platform. PolicyOptic is not an insurance company, broker, or agent, does not sell or bind insurance, and does not provide insurance advice or recommendations.
PolicyOptic organizes factual information extracted from documents you upload — what a document states, what changed, where documents differ, what may need clarification — all traceable to source. PolicyOptic does not rank, score, or declare any quote or policy “best,” “recommended,” or “adequate.”
Eligibility
You must be at least 18 to use PolicyOptic.
Accounts
You’re responsible for your account credentials and all activity under your account.
Boat Owner Use
You may upload documents for review, request quotes via the Marketplace, and maintain a Boat Passport. You control what’s shared and with whom. PolicyOptic doesn’t guarantee any quote or outcome from a Marketplace request.
Insurance Professional Use
You represent that you hold all licenses required in every jurisdiction where you offer, quote, or discuss insurance through PolicyOptic. You are solely responsible for the accuracy and compliance of any advice, quote, or guidance you provide. Guidance you add is attributed to you, not PolicyOptic.
The PolicyOptic Marketplace
Each opportunity is sold to one professional only and removed from availability once purchased. PolicyOptic does not guarantee any outcome from a purchased opportunity. Marketplace and subscription fees are described at the time of purchase or signup. PolicyOptic does not independently verify the accuracy of information in a Marketplace opportunity.
Acceptable Use
Don’t upload documents you don’t have the right to upload; don’t misrepresent your identity or licensing status; don’t attempt unauthorized access to another user’s account or data; don’t use the platform unlawfully or in violation of insurance regulation.
Intellectual Property
PolicyOptic and its branding are owned by PolicyOptic. You retain ownership of what you upload; you grant PolicyOptic a license to process it solely to provide you the service.
Disclaimers
PolicyOptic provides factual document organization only. It is not insurance advice and should not replace consultation with a licensed insurance professional. “Not Stated” means a detail wasn’t found in the documents reviewed — not that coverage doesn’t exist. THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of Liability
To the maximum extent permitted by law, PolicyOptic and its owners, officers, and personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the platform. PolicyOptic’s total liability for any claim arising out of or relating to these terms or the platform is limited to the greater of (a) the amount you paid PolicyOptic in the 12 months before the claim arose, or (b) $100. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify and hold harmless PolicyOptic and its owners, officers, and personnel from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: your use of the platform in violation of these terms; your violation of any law or the rights of a third party; or content or documents you upload that you do not have the right to share.
Dispute Resolution
Any dispute arising out of or relating to these terms or the platform will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will take place in Broward County, Florida, and will be governed by Florida law. You and PolicyOptic each waive the right to participate in a class action or class-wide arbitration. This section does not limit either party’s right to seek injunctive relief in court for misuse of intellectual property or unauthorized access to the platform.
Termination
We may suspend or terminate accounts for violations. You may close your account anytime.
Changes to These Terms
We may update these terms; continued use after changes take effect means acceptance.
